The terms "e-Collect", "We", "Us", "Our", "Website", "App" and "collect.org.in" shall mean and include AANVIN Digital Services & Solutions Pvt Ltd, a company registered under the laws of India having its registered address at ANVIN Corporate House, Kadupath Rd., Ponnurunni, Kochi, Kerala 682019, which owns e-Collect along with the Website and all Intellectual Properties associated with it. "You", "Your", "Yours", "User" shall mean the Company/ Corporation/ Partnership Firm/ LLP/ Society/ Trust/ Proprietary concern/ Individual(s) (hereinafter Business) that has registered at http://collect.org.in/ and avails the Service of e-Collect, and includes authorised user(s) operating under the Business as Administrator and other Users.
1.1. This ToS shall come into effect upon registration and activation of Your account. By accepting this ToS, you further agree to be bound by any amendments and to the terms incorporated herein by reference.
1.2. All policies including the Privacy Policy, Disclaimers and third-party terms form part of this ToS.
1.3. By registering and/or utilising the Services, you unconditionally agree to be bound by this ToS. If You do not agree, You shall not use the Services.
2.1 Registration: Registration is mandatory. You may contact your e-Collect POC for details. We reserve the right to refuse Service to anyone.
2.2 Eligibility: You are eligible only if You run an educational institution, tuition centre or similar institute (company, body corporate, LLP, partnership, trust, society, proprietary). The Authorised Person must be above 18 and competent to contract as per Indian Contract Act, 1872.
2.3 Payment: Service is on a Pay-per-Use model. Monthly/annual subscription fee as mutually agreed. GST as applicable. Additional payments for value-added services. Fees non-refundable if you stop using before term expiry.
3.1. AANVIN Digital Services & Solutions Pvt Ltd owns or holds license to all IP in e-Collect, the Website, and Services, including modifications and enhancements.
3.2. You acquire no title or IP rights.
3.3. You are solely responsible for your content and data entered into e-Collect. You represent that you have appropriate consents from data subjects.
4.1. You are entirely responsible for data entries, payment links, obtaining consents, etc. We are not liable for improper entries, payment failures.
4.2. You agree not to post/transmit profanity, false/misleading material, viruses, harmful content, cyber bullying, unlawful content, infringing third-party rights, etc.
4.3. You shall use the Service only for legal purposes and in compliance with this ToS.
4.4. You shall not tamper with our servers, probe security, interfere with other users, reverse engineer, or sub-license your account.
4.5 Refund policy: e-Collect facilitates; merchants handle refunds if applicable.
5.1. We use third-party payment aggregator: Cashfree
6.1. We only collect data you upload. It is stored in our servers and not shared with third parties.
6.2. Banking/financial details of your customers are not stored by us.

7.1. TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS, ETC.
7.2. e-Collect is a platform – we do not guarantee business success.
7.3. We are not liable for data loss due to viruses, hacking, server breakdowns.
7.4. No guarantee of uninterrupted service; factors beyond our control include internet, hardware, electricity, cloud uptime.
7.5. You are responsible for updating your data.
7.6. We are not responsible for content posted by you.
7.7. Not liable for Force Majeure events (pandemics, war, strikes, governmental acts, hacking, third-party failures).
8.1. You agree to indemnify Key Value Software Systems and affiliates from claims, damages, costs resulting from your use of e-Collect, violation of ToS, applicable law, or placement of any materials (IP infringement, defamation, spamming, damage to our servers).
8.2. You indemnify us from claims related to your customer's use of the Service.
9.1. You are solely responsible for consequences of using e-Collect.
9.2. We shall not be liable for indirect or consequential loss (loss of profit, data, goodwill) even if advised of possibility.
9.3. Our total liability under or in connection with this ToS shall not exceed the sum of the yearly subscription fee.
10.1. We may suspend or terminate for violation of terms or non-payment. Non-payment: suspension then termination after 15 days.
10.2. You will be notified and given an opportunity to cure.
10.3. Either party may terminate without reason. Pro-rata refund only if AANVIN terminates for reasons other than non-payment/breach.
10.4. Upon termination, accounts locked; data deleted after 90 days unless you request immediate deletion.
10.5. Termination does not extinguish unpaid dues or our rights to damages.
11.1. We may modify this ToS after notifying subscribers. Periodic review is your responsibility.
12.1. Not responsible for delay/default caused by natural catastrophes, epidemics, war, riots, change of law, etc. If continues >20 days, parties may mutually decide to terminate/suspend.
13.1. You shall not assign your rights to any third party.
13.2. We may assign to affiliates without notice if no interruption in Services.
14.1. Any dispute shall first be attempted to be resolved amicably; if not, referred to arbitration under the Arbitration and Conciliation Act, 1996. Venue: Ernakulam. Language: English.
15.1. This ToS shall be governed by the laws of India. Courts in Ernakulam, Kerala shall have exclusive jurisdiction.
